ARTICLE 5(1) OF THE LARGE COMBUSTION PLANT DIRECTIVE


Scottish and Southern Energy plc ('SSE') is applying to the Environment Agency for an extension to 15 October 2008 of its existing derogations under Article 5 (1) of the Large Combustion Plant Directive, in respect of Fiddler's Ferry and Ferrybridge power stations, based on contractors' estimates.


This is to allow it to operate the plant at the power stations which is opted in to the Directive, while completing the installation of flue gas desulphurisation equipment, which it continues to expect to do before the end of 2008. In practice, on the weighted and pro-rated basis, the extension to 15 October would allow SSE to increase from 1,270 to 1,397 the number of hours it is able to operate the opted-in plant at each of the power stations.


NOTE 

As in 2007, SSE will issue a summary of its trading position prior to entering its close period. This statement will be issued on 30 September 2008 in advance of the publication of its interim results for 2008/09 on 12 November.
