NMT Group PLC 16 February 2001 16 February 2001 NMT Group PLC Favourable Progress of Litigation On 9 February 2001, the Federal Court in Indiana granted summary judgment in favour of the Company and New Medical Technology, Inc. in respect of all counts of patent infringement alleged by Syringe Development Partners L.L.C. ('SDP') and Medsafe Technologies L.L.C. ('Medsafe'), relative to US patent no. 5,613,952 (the 'original SDP patent'), which is held by SDP, and of which Medsafe is the alleged sole licensee. The Court left open for trial the issue of invalidity of the original SDP patent. On 13 June 2000, a new US patent no. 6,074,370 (the 'new SDP patent') was issued to SDP. The new SDP patent is a continuation of the original SDP patent. The Company and New Medical Technology, Inc. have filed suit in Indiana for declaratory judgment relative to the new SDP patent on invalidity, non-infringement and unenforceability. SDP and Medsafe subsequently filed suit in Georgia for alleged infringement of the new SDP patent by the Company and New Medical Technology, Inc. Following an application to the court, on behalf of the Company and New Medical Technology, Inc., to have the infringement action in Georgia transferred to Indiana, this has now been agreed to and concluded, and the action has been transferred. The infringement action and the declaratory judgment action are to be heard before the same court as delivered the summary judgment on the original SDP patent.
