Lawsuit Against Max Ent Games
tinyBuild, a premium video games publisher and developer with global operations, announces that, on 11 August 2026, it filed a lawsuit against Max Ent Games Ltd. (formerly Merge Games) ("Max") in the United States District Court for the Western District of Washington regarding unpaid royalties relating to the game Smalland.
tinyBuild alleges Max failed to pay royalties owed to tinyBuild. Max acknowledged royalties are due, but the parties disagree regarding how to calculate the royalties owed. tinyBuild alleges that the full amount due by Max exceeds $1.9m, before interest and legal costs.
Further announcements will be made in due course as the lawsuit progresses through the courts.
